    City Planning Commission Hears Testimony on Proposed Greater JFK Industrial BID

    The proposed IBID’s geographic boundaries do not include the JFK airport itself, which ensures it would serve the needs of the surrounding off-airport community. On April 13, 2016, the City Planning Commission held a public hearing on the New York City Department of Small Business Services’ application to create the Greater JFK Industrial Business Improvement District, or IBID, located in Springfield Gardens, Queens. Though the proposed IBID would be the largest IBID in the City, it purposefully does not include within its boundaries the John F. Kennedy International Airport itself, which would ensure the needs of the off-airport community at-large remain the focus of the IBID’s efforts.

    Private rezoning withdrawn prior to Council review

    Cambria Heights community expressed concern about impact of proposed one-story commercial building on adjacent community garden. Prior to a public hearing before the City Council’s Zoning & Franchises Subcommittee, Ryan Pedram withdrew his rezoning proposal to extend a C1-3 commercial overlay to an existing R3-2 district at the northeast corner of Linden Boulevard between 226th and 227th Streets in Cambria Heights, Queens. Pedram had requested the rezoning in order to develop a one-story, 8,100 sq.ft. commercial building on a vacant lot adjacent to a community garden owned by the Trust for Public Land.

    Linden Boulevard is the main commercial corridor in Cambria Heights and is characterized by low-rise commercial, mixed-use, and residential buildings. In 2005 the City approved a contextual rezoning of Cambria Heights. 2 CityLand 100 (Aug. 15, 2005). Pedram’s property was residentially developed at the time and its R3-2 zoning was left unchanged. East of Pedram’s property, Linden Boulevard is zoned R3-2 with a C2-3 commercial overlay. To the west, Linden Boulevard is zoned R3-2 with C1-3 commercial overlay. Pedram initially proposed extending the C1-3 overlay 90 feet east to include his lot and ten feet of the community garden. (read more…)

    Residential building grandfathered despite opposition

    Owner completed 99 percent of building’s foundation before City Council approved Astoria Rezoning plan. Plaza Group 36 LLC obtained excavation and foundation permits to begin work on a four-story residential building at 30-86 36th Street in Astoria, Queens. On May 18, 2010, Buildings issued a new building permit to Plaza Group for the project. One week later, the City Council approved the Astoria Rezoning, changing the site’s R6 zoning to R5B and rendering the 6,565 sq.ft. eight-unit project out of compliance with the district’s maximum permitted floor area and number of dwelling units.

    Buildings inspected the site two days after the rezoning and initially determined that Plaza Group had completed the foundation by the enactment date. Buildings, however, issued a stop work order the next month after finding that three interior footings for steel columns were not completed before the rezoning. (read more…)

    Laurelton rezoning approved

    Council approves 220-block rezoning without modification. On September 4, 2008, the City Council approved the rezoning proposal for Laurelton, a Queens community near the border of Nassau County. The plan includes lower-density and contextual rezoning for approximately 215 blocks, an upzoning from C8-1 and R3-2 to R5D along Merrick and Spring Boulevards, and commercial overlay changes to more closely match existing commercial development.

    The plan culminates over six years of research, planning, and community outreach. Laurelton residents first approached the Department of City Planning in 2002, citing numerous residential developments of attached, semi-detached, and multifamily structures out-of-character with the existing neighborhood. In response, Planning proposed a rezoning that would prevent lot subdivision and preserve the one- and two-family detached housing character of the community yet still allow for modest residential and commercial retail growth along Laurelton’s primary thoroughfare.     BSA denies variance for retail development

    Variance  •  Jamaica, Queens

    Developer sought to convert site formerly occupied by a gas station. The owner of a site located in an R3-2 zoning district sought a use variance to construct a one-story retail building. The site, located at 146-93 Guy R. Brewer Boulevard, is currently occupied by a former gas station/auto repair facility that was subject to a use variance that expired in 1997.

    The owner argued that it could not develop the site for residential use because it is located on a busy intersection, has a history of commercial use, and once stored underground fuel tanks. Both Queens Community Board 13 and Borough President Helen Marshal, however, recommended that BSA disapprove the variance, citing their concerns over the impact the proposed retail establishment would have on adjacent homes to the east of the site.     Freight transfer facility allowed to work on Sundays

    Amendment  •  Springfield, Queens

    Post-9/11 changes required amendment to 1996 BSA resolution. Compass Forwarding operates a freight transfer facility near JFK Airport at 159-15 Rockaway Blvd. in Springfield, Queens. In 1996, Compass obtained a variance to permit enlargement of its transfer station on condition that operations would be suspended Sundays. In July 2005, Compass applied to BSA to amend the terms of the variance to allow Sunday operation so that it could comply with post-9/11 regulations for air freight transfer and holding.

    Compass argued that under new federal regulations all freight must be removed from holding areas within four hours of arrival, and requested that it be permitted to operate one truck to transfer Sunday arrivals between 10:30 a.m. and 6:00 p.m. BSA recommended that Compass shorten its proposed hours of operation by using two trucks to transfer freight on Sundays. Compass responded that the time frame was necessary to accommodate potential flight delays. (read more…)
