Tenants of a Tribeca high rise luxury rental building claimed protection of rent stabilization. Tenants of Tribeca House, a luxury rental residential building located at 50 Murray Street, Manhattan claimed that the owner of the building overcharged the tenants. Tribeca House, a twenty-one-story luxury loft apartment building, has 389 apartments comprised of studio, one, two, and three bedroom units. (more…)

Applicant faces uphill battle to turn parking lot into residential building. On June 13, 2018, the City Planning Commission held a public hearing on an application by Camber Property Group for rezoning at 1601 DeKalb Avenue in Bushwick, Brooklyn. The rezoning will facilitate the construction of a new residential building. The rezoning will affect three lots owned by Camber and seven lots not owned by the applicant. The new building, however, will be constructed on the three lots owned by Camber, which is currently a parking lot. (more…)

Proposed additions to recently designated buildings, known for housing artists of the Abstract Expressionist movement, reduced in visibility with modifications to design to better relate to existing building. On April 24, 2018, the Landmarks Preservation Commission considered a revised proposal to create a rooftop addition to the 827-831 Broadway Buildings, an individual City landmark designated in October of 2017. The buildings were designated partially for its architecture as proto-cast-iron commercial architecture, designed by Griffith Thomas and inspired by Italian palazzi, and also for their association with 20th century art. Willem De Kooning lived and worked in 831 Broadway, and other artists that lived in the buildings included Elaine de Kooning, Larry Poons, Jules Olitsky, and Paul Jenkins. (more…)

New industrial modern loft building for Bronx area scarce with residential options. On March 14, 2018, the City Planning Commission held a hearing on the Willow Avenue Rezoning application. The applicant, Markland 745 LLC, seeks to develop a mixed-use, mostly residential building on Willow Avenue between East 133rd and East 134th Street in the Port Morris section of the Bronx. The property is currently occupied by a three-story commercial office building and a single-story warehouse. The current buildings will be demolished to make way for the new development. The application includes a rezoning from a manufacturing district to a mixed residential, manufacturing, and commercial district zone and mapping of a mandatory inclusionary housing (MIH) area for the property. Graffiti has become much more than spray-painted tags and quickly disappearing pieces on train cars and underpasses. In some quarters it is now high art. Highly prized are works by Shepard Fairey, the artist behind the “Hope” poster Fairey made for Barack Obama’s presidential campaign, Jean-Michel Basquiat, who began as a graffiti artist and whose works today command huge prices, and Banksy, whose street works are carefully preserved. These dramatic changes in the nature and importance of graffiti have created major shifts in and problems for artists and intellectual property law, as well as for property owners. The tensions are very evident in the most recent judicial opinions in the dispute between artists who used to paint at 5Pointz in Long Island City in Queens and the developers who destroyed the highly decorated buildings for construction of two large apartment buildings which are now under construction.
