Building owner challenged loss of advertising rights. In 1998, Astoria Landing purchased an existing four-story apartment building located in a residential zone at 24-59 32nd Street in Astoria, Queens. The building’s previous owner had obtained a permit to display commercial advertisements and begun to display advertisements in the 1940s. In 1961, the City adopted new zoning rules which banned the display of advertisements in residential areas. In 1981, the Department of Buildings erroneously renewed the previous owner’s permit. After the purchase of the building in 1998, Astoria Landing continued to display commercial advertisements. (more…)

Commissioners raised concerns about the removal of special permits as a way to vet out illegitimate massage parlors. On October 20, 2021, the City Planning Commission voted to approve two applications proposed by the City to support small businesses and promote healthy food options and fitness. The two applications, the FRESH Program Expansion and the Health and Fitness Text Amendment, were part of a series of zoning proposals proposed earlier this year. (more…)

The proposed rezoning will allow for the facilitation of a new physical cultural establishment and the promotion of vibrancy and public engagement. On July 28, 2021, the City Planning Commission approved a zoning map amendment proposed by Beach 116th Associates LLC to facilitate the development of a gym located at 133 Beach 116th Street in Rockaway Beach. To facilitate the creation of the gym, the applicant requested a zoning map amendment to change the present residential district that allows for a local retail space to a residential area that allows for more diverse businesses like gyms, theatres, and more. Zoning is under attack in New York City. Not here or there, in this location or that, but the concept itself. This has been the long game of the city’s real estate interests, and after a decade of raids those interests have launched a full assault on several fronts. Developer received permit to build record-setting skyscraper on the West Side of Manhattan. In November 2017, Extell Development Company unveiled plans to build a massive residential tower for luxury condominiums at 36 West 66th Street. The building, if completed at 775 feet tall, would be the tallest on the Upper West Side of Manhattan. Extell applied for and received a permit from the Department of Buildings after making slight modifications to the structural design in order to accommodate, primarily, fire safety concerns. (more…)
