    Commercial tenant unprotected by new law

    Commercial tenant claimed the 2019 Housing law required owners to provide a written notice of nonpayment of rent. The owner of a building located at 41 East 11th Street, Manhattan, filed a petition in Civil Court to evict its commercial tenant, Washington Square Institute, for non-payment of rent. The owner claimed rent in the amount of $240,007 for the period of August 2019 through October 2019, calculated at the monthly rent of $67,561. The owner moved for summary judgment. (read more…)

    HPD Seeks Enhanced Enforcement Against City’s Worst Buildings

    HPD picked 250 buildings with over 41,000 violations for enhanced enforcement. In 2019, the New York City Department of Housing Preservation and Development (HPD) launched the Anti-Harassment Unit (AHU) to keep tenants safe and to hold owners and landlords accountable for leaving homes in disrepair. On March 4, 2020, HPD announced that the AHU filed actions for nearly $400,000 against two building owners in court. Each building owner operates three buildings in Manhattan and the Bronx.     Landlord faulted for no rent receipts

    Tenant paid rent but received no receipts from landlord. Francisco Pacheco lived in a rent-stabilized apartment in the Bronx, managed by Mayflower Properties, LLC. Mayflower Properties sued Pacheco for back rent of $11,575, later increasing the claim to $16,011. (read more…)
