    NYC Mayoral Candidates Land Use Policy Recap

    The Mayoral Election will help shape the City’s land use and housing policymaking decisions. Between now and June 20th, early voting is available for the NYC Primary, in which New Yorkers will help decide who will be the next Mayor of New York City. Over the course of their campaigns, mayoral candidates have developed and shared their positions on a variety of land use and housing issues including developing affordable housing, handling the eviction and homelessness crisis, revising land use review processes, how to develop underutilized space, NYCHA, and building inspections.  (more…)

    Landlord loses eviction action

    Landlord sued to evict tenants from six-unit building in order to provide apartment for son. Shlomo Karpen owns a six-unit, rent-stabilized building in Brooklyn comprised of two rented units on the first, second and third floors. In June 2018, Karpen notified the tenants in the rented apartments that he would not renew their leases and intended to take over the apartments to make a four-bedroom apartment for his son. In October 2018, Karpen commenced an eviction proceeding against the tenants. Before the case could be completed, the State Legislature passed the Housing Stability and Tenant Protection Act of 2019, which amended Rent Stabilization Law Section 26-511(c)(9) to provide that a landlord can recover only one apartment in a building for owner occupancy and must show compelling necessity.     Governor Cuomo Extends Eviction Moratorium Through August

    Advocates and industry leaders calling for more protections and more action from Governor. On May 7, 2020, New York Governor Andrew Cuomo issued Executive Order No. 202.28, extending the eviction moratorium through August 20, 2020. The moratorium prevents the filing of eviction proceedings against both residential and commercial tenants. The original eviction moratorium, came by way of Chief Administrative Judge Lawrence K. Marks on March 15, 2020, and was reinforced by Governor Cuomo’s Executive Order No. 202.8, on March 20, 2020. The March 20 order extended the eviction moratorium through June 20, 2020.     Landlord Loses Eviction Motion

    Taiwanese man on student visa sought succession rights in rent-stabilized apartment after his partner’s untimely death. Ta-Wei Yu, a Taiwanese citizen, has resided in New York City since being admitted to the United States in 2005 on a still-valid F-1 student visa. While pursuing his doctorate in music, Yu entered into a committed romantic relationship with a native New Yorker. In 2012 Yu moved into his partner’s rent-stabilized apartment. His partner died suddenly in 2015, leaving Yu as the sole tenant. (more…)

    De Blasio Administration Expands Benefits of Rent Freeze Programs

    The Housing Stability and Tenant Protection Act makes it possible to freeze rents at preferential rates for qualifying New Yorkers. On September 18, 2019, the de Blasio administration released guidance regarding renter rights under the Housing Stability and Tenant Protection Act. This guidance will allow New Yorkers who pay preferential rents in rent stabilized apartments to benefit from the City’s Rent Freeze Programs. (more…)
