    Audit Faults Shelter Contracts

    State Comptroller’s audit criticized the high costs of past homeless shelters leases; the agency responded that it is in the process of tightening its leasing procedures. In October of 2017, the New York State Comptroller’s office released an audit regarding contracts signed over the past four years between the City and landlords providing homeless shelters. The audit found that the Department of Homeless Services does not have written policies and standard operating procedures for key aspects of shelter contract procurements and rate-setting processes and that such documentation is neither readily available nor maintained, as required the City.     Property owner wins indemnification

    Property owner sued general contractor and design consultant for indemnification of costs resulting from violations of federal, state, and local disabilities law. CREF 546 owned property located at 546 West 44th Street in Manhattan and hired developers to construct two fourteen-story residential midrise apartment buildings that shared amenities. CREF 546 contracted with Code Consultants to review design and construction documents and Hudson Meridian as their general contractor. The building became occupied in 2016. (more…)

    Conflicts Board Adopts New Rules on Post-Employment Restrictions and Gifts

    On October 8, 2020, the Conflicts of Interest Board adopted new and important changes to its post-employment rules that restrict former City employees from contacting their former City agencies. The Board, in addition, on May 21, 2021, adopted rules relating to the acceptance of gifts by City employees in certain recurring situations. This article examines these new rules. (more…)

    Enforcement of sex shop rules halted

    Adult entertainment businesses continue their decades-long fight against zoning rules that restrict business locations. In the latest installment in the City’s efforts to restrict adult entertainment establishments, a federal court enjoined enforcement of the City’s zoning resolution.     Homeowner’s Cash Award Remanded

    Homeowner claimed home improvement contractor did incompetent work. Favors and Company Inc., a home improvement contractor, and Edmina Lee, a homeowner, entered into a series of home improvement contracts to make repairs for her two properties located at 112-28 199th Street and at 186-21 Hilburn Avenue, Queens. Work related to the 199th Street property occurred between April 28, 2014 and May 23, 2014. Work related to the Hilburn Avenue property occurred between May 15, 2014 and June 26, 2014. (more…)
