    City Planning Commission Approves Special Permit For Subway Elevators on 45 Broad Street

    Application approval will bring ADA accessibility to Downtown Manhattan. On April 23, 2018, the City Planning Commission approved the application for a special permit to allow a floor area bonus (FAR) of up to 20 percent to the basic maximum FAR to the 45 Broad Street development in connection with proposed subway improvements. The application was submitted by Madison 45 Broad Development LLC. The special permit will allow the construction of two subway elevators on the Broad Street and Wall Street stations, as part of an application for a new mixed-use residential building.     Brooklyn Community District 10 Seeks Removal from Zoning Resolution Special Permit

    Special Permit was meant to allow growing families to expand their familial residences, but Brooklyn Community Board 10 argues that its usage has been abused. On June 20, 2016, a proposal was presented to the City Planning Commission to amend the New York City zoning text relating to the Board of Standards and Appeals Special Permit provisions under Section 73-622, which provides for the enlargement of one- and two-family detached and semi-detached residences. Currently, Section 73-622 only applies to four Community Districts, and it permits additions to the perimeter wall height, and extensions into the requisite rear yards and side yards of the residences located within those Community Districts.

    City Planning Approves Proposal for New 40-Story Tower in Downtown Brooklyn

    The development which requires a significant upzoning, special permit, and several building envelope requirement modifications will now proceed to City Council for review and approval. On December 5, 2018, the City Planning Commission held a public hearing on a proposed mixed-use development at 570 Fulton Street, located within the Special Downtown Brooklyn District. The applicant, 570 Fulton Street LLC, is proposing to build a 40-story, approximately 202,000 square foot building containing a mix of office space, residential apartments, and retail. To facilitate this development, the applicant is seeking three approvals including a zoning map change, a zoning text change, and the creation of a special permit that would unlock several building envelope waivers sought by the applicant. The project was presented by the applicant team comprised of Allison Curreri and Jay Segal of Greenberg Traurig, David West from Hill West architects, and David Schwartz of Slate Property Group. On January 9, 2019, the City Planning Commission approved the project, which will proceed to City Council. (more…)

    Chelsea garage legalized

    625-space garage had been operating over capacity since approximately 2003. On July 1, 2009, the City Planning Commission approved 111 Eighth Avenue Parking LLC’s application for a special permit allowing it to continue to operate a 625-space garage on the ground floor and cellar of an office building located between West 15th and 16th Streets, and Eighth and Ninth Avenues in Chelsea. The applicant began operating the 126,677 sq.ft. garage in 1999. It reached its current 625-space capacity a few years later, exceeding the 276 spaces permitted by the building’s Certificate of Occupancy.

    At the Commission’s hearing, a representative for the garage apologized for its delay in rectifying the overcapacity, claiming that it had been unfamiliar with the application process for a special permit. Another representative stated that the garage had been consulting with the community and, based on community input, agreed to provide bicycle parking and storage at the garage. (more…)
