    CPC Holds Hearing on Proposed Oxford Nursing Home in Red Hook

    Opponents of the nursing home are primarily concerned about its proposed location being within a flood zone. On March 30, 2016, the City Planning Commission heard testimony on an application submitted by Conover King Realty, LLC, on behalf of Oxford Nursing Home, to build a new nursing home in the Red Hook neighborhood of Brooklyn. The proposed nursing home would be eight stories tall with the capacity to hold 200 beds and would serve to re-locate the existing Oxford Nursing Home located in Brooklyn’s Fort Greene neighborhood.

    BSA grants Red Hook developer time extension for warehouse conversion

    BSA, which had granted variance to developer in 2003, grants time extension due to five-year court battle. In 2003, the Board of Standards & Appeals granted a use variance to 160 Imlay Street Real Estate LLC to allow for the residential conversion of a six-story warehouse at 160 Imlay Street in Red Hook, Brooklyn. 160 Imlay Street LLC had claimed that it could not earn a reasonable rate of return with a complying use under the site’s M2-1 manufacturing zoning designation. The Red Hook-Gowanus Chamber of Commerce filed an article 78 petition challenging the variance. The Chamber, however, failed to name 160 Imlay Street LLC in the petition, and the City asked the State Supreme Court to dismiss the proceeding. The issue was appealed up to the Court of Appeals, which sent the case back to the Supreme Court. (read CityLand’s coverage here).

    Supreme Court Justice Yvonne Lewis ruled that the lawsuit could continue without 160 Imlay Street LLC as a named party, and then vacated the variance. Justice Lewis returned the matter to BSA to determine whether 160 Imlay Street (more…)

    Buildings Exempted from Rent Law

    Red Hook developer converted commercial buildings into residential apartments. Harbor Tech LLC in 1999 purchased a commercial complex located in the Red Hook neighborhood of Brooklyn that had been built in the 1920s and used continuously for commercial purposes. Harbor Tech by 2005 had converted the five interlaced buildings of the complex into 100 residential units.

    Thirty-five residents of the complex in 2013 sued Harbor Tech to have the City’s Rent Stabilization Law applied to the complex. In response, Harbor Tech argued that the complex was exempt from the Rent Stabilization Code because the buildings were “substantially rehabilitated” as residential units after 1974. The residents argued that the exemption did not apply because the regulations define “substantially rehabilitated” as requiring the replacement of at least 75 percent of the building-wide and apartment systems. The Supreme Court rejected the tenants’ argument, ruling that rent stabilization laws did not apply because the complex had been converted from commercial to residential, and the percentage of systems replaced was irrelevant.     CPC Agrees to Legalize Overbuilt Building for Expanding Non-Profit

    City Planning Commission approves legalization and expansion of Red Hook non-profit servicing the needs of the community. On February 22, 2017, the City Planning Commission voted to approve an overbuilt building located at 763 and 767 Hicks Street in Brooklyn’s Red Hook neighborhood. The site contains two one-story buildings used by the applicant, the Red Hook Initiative. The two addresses total 4,794 square feet and rise to 19 and 21 feet high. Both buildings were zoned M1-1, which allows a maximum of 1.0 floor area ratio. Therefore both buildings were previously used as warehouses prior to the Initiative’s tenancy. (more…)

    Ikea Development Approved; Sent to Council

    Ikea to build a 346,000-square-foot waterfront store in Red Hook. The City Planning Commission approved an application by Ikea Property, Inc., for the development of a 346,000-square-foot furniture store and three ancillary buildings on a 22-acre site along the Red Hook, Brooklyn waterfront. The store, Ikea’s first in New York City, will be its largest store in the United States. The Commission also approved 70,000 sq.ft. of retail and restaurant space and a 6.3-acre public esplanade/bikeway.

    Red Hook is primarily zoned M3-1 for heavy manufacturing. Recently, the neighborhood has begun a slow revitalization with the opening of the Community Justice Center in 2000 and with increasing private renovations to its residential and neighborhood retail buildings. (more…)
