    Queens Rezoning Application Sees Opposition From Residents

    Mixed-use building seeks to bring residential and commercial space, but residents do not agree. On May 23, 2018, the City Planning Commission held a public hearing on the 40-31 82nd Street Rezoning application by The Heskel Group under representation by Nora Martins of Akerman LLP. The application seeks a zoning map amendment and zoning text amendment to develop a mixed-use building with residential, commercial, and community facility space in a currently vacant lot. The project site is located along Ithaca Street, Baxter Avenue and 82nd Street in Elmhurst, Queens. (more…)

    Trespass Damages Of $750,000 Upheld

    Land developer’s construction of building encroached upon neighbors’ land. Britton Property, Inc., a developer, constructed a new six-story residential building located on Britton Avenue, in Elmhurst Queens. Britton installed 17 steel I-beams, a roof cap, and a brick façade that physically encroached on surrounding properties and the properties’ airspace. Britton’s architectural plans provided for the beams to be installed temporarily on the surrounding properties, but Britton failed to remove them. (more…)

    Designation of 280-Year-Old Church Building Proceeds Apace

    No objections to designation raised at hearing; concerns about closeness of potential development on undesignated portion of lot to church building raised by Commissioners. On August 8, 2017, Landmarks held a hearing on the potential designation of the Old Saint James Episcopal Church at 86-02 Broadway in the Elmhurst section of Queens. Landmarks added the 1736 building to its calendar at its June 27, 2017, meeting. The building is the second oldest surviving religious structure in the City, predated only by the 1694 Friends Meeting House in Flushing, an individual City landmark.  The western portion of the lot on which the church sits is paved and used as a parking lot, and would not be included in the designation.
