Court found that application was not filed within the statutory time period of one year. On January 27, 2016, the New York State Supreme Court denied a Brooklyn developer’s petition to reverse a Department of Finance decision to not grant a tax abatement. The Developer, 96 Wythe Acquisitions, filed the petition after the Department of Finance denied the application for the tax abatement because it was not filed within the mandatory one-year requirement. 96 Wythe Acquisition LLC filed plans with the NYC Department of Buildings back in April 2013 to construct a hotel in the Williamsburg section of Brooklyn. On March 8, 2023, the New York League of Conservation Voters and NYLCV Education Fund released the 2023 New York City Policy Agenda, which cited support for Mayor Eric Adams’ City of Yes for Carbon Neutrality zoning text amendment. The New York League of Conservation Voters is a statewide environmental organization that advocates for clean water and air, renewable energy and open spaces. (more…)

Commissioners raised early questions about implementation and funding issues. On January 30, 2023, the City Planning Commission held a review session and overview discussion for the proposed Zoning for Carbon Neutrality amendment, one of the three City of Yes amendments proposed by Mayor Eric Adams last year. The Zoning for Carbon Neutrality amendment aims to reduce or eliminate unnecessary restrictions within the zoning text that inhibit a developer or building owner from using sustainable technology and design in their properties. While the official text of the amendment is not finished at this time, this hearing provided an overview about the goals of the amendment and highlighted common issues to be addressed by the amendment. On January 19, 2023, Governor Kathy Hochul announced that over $390 million was awarded through bonds and subsidies for affordable and supportive housing statewide. With additional private funding, over $600 million is expected to be invested to preserve over 1,600 units in ten projects across the state, including four projects within New York City. The four New York City projects are Bedford Green House Phase II in Fordham Heights in the Bronx; Shepherd Glenmore in East New York, Brooklyn; Crotona Belmont Senior Housing in East Tremont in the Bronx; and River View Towers in Hamilton Heights, Manhattan. The new development is part of an initiative to bring 4,000 affordable units to Central Brooklyn. On November 30, 2022, Governor Kathy Hochul announced the completion of a new affordable and supportive development in Brownsville, Brooklyn.
