City Planning Commission Considers Rezoning Near Brooklyn Botanical Garden

If approved, the rezoning will make way for construction of over 500 new apartments in Crown Heights. On September 26, 2018, the City Planning Commission held a public hearing on a rezoning application for Franklin Avenue in the Crown Heights section of Brooklyn. The rezoning would allow construction of two new 16-story buildings at 40 Crown Street and 931 Carroll Street. Both buildings are a block east of the Brooklyn Botanical Garden.


421-a Property Tax Process Renewed

The revised Section 421-a offers new opportunities for affordable housing. The 421-a property tax exemption began in 1971 as an incentive for developers to develop badly needed housing in New York City. Rent-stabilized tenant substantially profited from 93 individual Airbnb sublettings. In 2010, Linda Lipetz was diagnosed with cancer and was unable to work for over a year. From March 2011 to August 2012, in order to subsidize her rent, Lipetz sublet her rent-regulated apartment located at 39 Fifth Avenue in Greenwich Village. Landlord Wins Decontrol Dispute in First Department

Post-vacancy rent increase raised rent beyond $2,000 threshold and resulted in decontrolling a rent-stabilized apartment. In November 2003, Craig Smith and Elise Stone rented an apartment at 233 East 5th Street in Manhattan. Prior to their occupancy, the previous tenant resided in the unit as a rent-stabilized tenant. The “421-a Extended Affordability Program Rules” would provide a 10 to 15 year extension to eligible buildings enrolled in the program prior to its expiration. On March 14, 2016, the Department of Housing Preservation and Development proposed two agency rules to extend the 421-a real property tax exemption program for those who already had been benefiting from the program prior to its expiration in June 2015.
