Local community board generally supported 90-block rezoning, but requested that portion of West 145th Street be downzoned to protect existing HUD buildings. On October 3, 2012, the City Council’s Zoning & Franchises Subcommittee heard testimony on the Department of City Planning’s proposal to rezone 90 blocks in West Harlem. The rezoning would impact approximately 1,900 lots generally bounded by West 155th Street to the north, West 126th Street to the south, Bradhurst Avenue to the east, and Riverside Drive to the west. City Planning’s proposal seeks to protect the area’s existing residential character, create incentives for affordable housing development, encourage appropriate growth along retail corridors, and create opportunities for mixed-use development in the area’s manufacturing zone.
West Harlem is predominantly characterized by medium-density residential development, including three- to four-story rowhouses and larger five- to six-story apartment buildings. Taller residential buildings can be found on the blocks between Broadway and Riverside Drive. A major retail corridor with active residential use spans West 145th Street, while commercial overlays also cover portions of Broadway and Amsterdam Avenue. A small manufacturing area located in the southernmost tip of the rezoning area includes the partially demolished former Taystee Cake Factory complex, the Mink Building, and Metropolitan Transit Authority facilities.

Brad Lander
Council Member Brad Lander, chair of the City Council’s Landmarks, Public Siting & Maritime Uses Subcommittee, draws from his experience as a public policy advocate when executing his duties.
Originally from St. Louis, Missouri, Lander in 1991 earned a liberal arts degree from the University of Chicago. He then earned a master’s degree in Social Anthropology at the University College London in the United Kingdom, where he worked with community groups to research how a controversial plan to redevelop the London Docklands would impact local maritime communities.
Lander in 1993 returned to the United States and joined the Fifth Avenue Committee, a Brooklyn community group that advances economic and social justice. During his tenure Lander earned a second master’s degree in City and Regional Planning from the Pratt Institute. In 2003 he was named director of the Pratt Center for Community Development. He was also involved in advocating for the use of inclusionary zoning, which allows developers to construct larger buildings in exchange for allocating a portion to affordable housing. Astoria’s 238-block contextual rezoning received strong support from Council Member Vallone. On May 25, 2010, the City Council approved the Department of City Planning’s contextual rezoning plan for Astoria, Queens. The plan impacts 238 blocks bounded by 20th Avenue to the north, Broadway to the south, Steinway Street to the east, and the East River and Vernon Boulevard to the west. The rezoning replaces the area’s predominant R5 and R6 zoning with contextual zoning districts, including lower density R5B, R5D, R6A, and R6B districts that establish height limits and reinforce the residential neighborhood’s development patterns. Planning applied commercial zoning districts to 67 blocks developed with mixed uses, including the 31st Street corridor, which includes the elevated N and W subway lines. The City’s Inclusionary Housing Program will now apply to seventeen blocks rezoned to R7A.
At the City Planning Commission’s hearing, residents were supportive of the proposal, noting that the rezoning was necessary to prevent out-of-scale development and protect the area’s infrastructure. Two property owners, however, asked the Commission to modify the rezoning to accommodate their lots. (more…)

Richard Bearak
Richard Bearak, Director of Land Use for Brooklyn Borough President Marty Markowitz, had originally intended to be an architect. But as an undergrad at the New York Institute of Technology (NYIT), Bearak unexpectedly developed an interest in city planning. After receiving a degree in Architectural Technology, Bearak was admitted to Hunter College’s urban planning graduate program in 1981.
Upon finishing school, Bearak worked in the private sector designing subdivisions and clustered developments in southwestern Connecticut. He later joined the staff of the Department of City Planning’s Queens Office for three and a half years, followed by the Department of Housing Preservation and Development while obtaining a degree from NYIT in architecture and becoming a licensed architect. In December 1993, he left to work in Brooklyn Borough President Howard Golden’s land use office as a senior planner. Bearak was later named the office’s Deputy Director of the Planning and Development Unit, and he continued in that position under Markowitz. Text amendment would introduce curb cut prohibitions and limit front yard parking spaces in certain residential districts. On February 24, 2010, the City Planning Commission approved, with modifications, the Department of City Planning’s Residential Streetscape Preservation text amendment. Planning proposed the City-wide amendment in response to community concerns about inappropriate curb cuts and front yard parking spaces in residential districts. Planning seeks to clarify parking requirements and preserve and enhance residential streetscapes.
The proposed amendment includes a host of modifications such as requiring new parking spaces in all single- and two-family districts to be located within a residential building or to the side or rear of a building. This requirement currently applies to R1 and R2 districts and certain districts in Lower Density Growth Management Areas in Staten Island and the Bronx. In order to ensure that required front yard plantings are of sufficient quality, the amendment would close a loophole that allows narrow strips of plantings located in driveways to count towards the required minimum front yard planting requirements.
