Loft occupant moved out prior to applying for protected status. Frank Hughes was a resident at 401 Wythe Avenue, Brooklyn, New York, a commercial building with several residential units. In 2012, Hughes and other residents of the building applied to the New York City Loft Board for Loft Law occupant protection status, which referred the applications for an OATH hearing. The 401 Wythe Avenue residents sought Loft Law status because lofts in split commercial/residential buildings (known as interim multiple dwellings) may ignore certain regulations imposed on commercial buildings. New York City excused for default on a lawsuit regarding water allowance arrears. A&F Scaccia operates a concrete manufacturing plant at 104-17 148th Street in Jamaica, Queens. Between 2007 and 2015, the NYC Department of Environmental Protection charged A&F Scaccia Realty Corp. for low-estimated water readings due to a broken water meter on their commercial property. On discovery of the error, the DEP reassessed the concrete company’s water usage in 2016 and charged A&F Scaccia for $88,000. The fine reflected two years of unpaid usage fees for the access to the NYC’s water supply. (more…)

City approved homeless shelter for single men in former single-room-occupancy building on West 58th Street. As part of its “Turning the Tide on Homelessness” initiative, the City planned to operate a homeless shelter in a building at 158 West 58th Street, located on Manhattan’s “Billionaires’ Row.” The nine-story building was constructed in 1910. The building initially operated as single-room occupancy housing and later as the Park Savoy Hotel. The building’s new owner, New Hampton, LLC, partnered with the non-profit organization Westhab, Inc. to convert the building to a homeless shelter for 150 employed or job-seeking men. (more…)

A rigging accident at a construction site killed a pedestrian. On March 10, 2017, a pedestrian was struck and killed by falling debris that became pried loose during rigging operations at a construction site located at 364 Meredith Avenue in Staten Island. Joseph Volpe, the Master Rigger on the job, delayed notifying the Department of Buildings about the incident despite being required to do so. Following the accident, Buildings revoked Volpe’s Master Rigger’s licenses to hoist materials and issued five summonses charging various building code violations. (more…)
