    Brooklyn Community District 10 Seeks Removal from Zoning Resolution Special Permit

    Special Permit was meant to allow growing families to expand their familial residences, but Brooklyn Community Board 10 argues that its usage has been abused. On June 20, 2016, a proposal was presented to the City Planning Commission to amend the New York City zoning text relating to the Board of Standards and Appeals Special Permit provisions under Section 73-622, which provides for the enlargement of one- and two-family detached and semi-detached residences. Currently, Section 73-622 only applies to four Community Districts, and it permits additions to the perimeter wall height, and extensions into the requisite rear yards and side yards of the residences located within those Community Districts.

    Zoning Subcommittee Modifies Special Permit for Broome Street Conversion

    Permit will allow Use Group 2 residential on the third through sixth floors only.  On March 9, 2015 the City Council Subcommittee on Zoning and Franchises voted to approve a modified special permit for the conversion of 498 Broome Street in the SoHo-Cast Iron Historic District of Manhattan to Use Group 2 residential.  The approved permit restricts conversion of the building to Use Group 2 residential for only the third through sixth floors, and leaves the cellar, first, and second floors subject to the standing zoning regulation which permit Joint Live-Work Quarters for Artists.  The permit as originally requested would have allowed Use Group 2 on portions of the first floor and all of the second through sixth floors.

    On Wednesday, June 1, Mayor Eric Adams outlined his, “City of Yes” initiative. This initiative is the next phase of his, “Rebuild, Renew, Reinvent,” plan to stimulate recovery from the COVID-19 pandemic. “City of Yes,” is built around a series of three as-yet-unwritten zoning text amendments to modernize and simplify zoning resolutions to encourage business growth, stimulate housing creation, and reduce the city’s carbon footprint.     City Planning Approves Rockaway Beach Rezoning for Mixed-Use Buildings to Create a Gym

    The proposed rezoning will allow for the facilitation of a new physical cultural establishment and the promotion of vibrancy and public engagement. On July 28, 2021, the City Planning Commission approved a zoning map amendment proposed by Beach 116th Associates LLC to facilitate the development of a gym located at 133 Beach 116th Street in Rockaway Beach. To facilitate the creation of the gym, the applicant requested a zoning map amendment to change the present residential district that allows for a local retail space to a residential area that allows for more diverse businesses like gyms, theatres, and more.     Zoning is under attack in New York City. Not here or there, in this location or that, but the concept itself. This has been the long game of the city’s real estate interests, and after a decade of raids those interests have launched a full assault on several fronts.
