    Elected officials and real estate professionals debate solutions and strategies to City’s affordable housing shortage. On October 1st, 2014 the City University of New York’s CUNY Forum series held a panel discussion titled “Affordable Housing and Social Justice in NYC”. The panel featured Manhattan Borough President Gale Brewer, Vishaan Chakrabarti of SHoP Architects and Associate Professor at Columbia University, Real Estate Board of New York President Steven Spinola, and Council Member Jumaane D. Williams. The debate was moderated by CUNY Forum’s host Bob Liff.

    Behind New York City Development, Land Use Attorney Jesse Masyr

    Jesse Masyr

    Attorney Jesse Masyr brings unique expertise from the public sector to help developers navigate the City’s public review process. CityLand spoke with Masyr at his Midtown office about his career in land use law.

    Masyr, who grew up in Bensonhurst, Brooklyn, attended Tulane School of Law in New Orleans. Masyr majored in American history as an undergraduate at Harpur College (now SUNY Binghamton) and was fascinated by the antebellum period. Masyr figured that if he did not complete law school, New Orleans would be a great place to continue studying history. Masyr’s backup plan was unnecessary, and he earned his J.D. in 1975. After returning to the City, Masyr acted as Carol Bellamy’s press secretary during her run for City Council President. Bellamy’s election was certain after the primary, so Masyr joined the campaign of Andrew Stein, who was still facing a general election fight in his bid for Manhattan Borough President.

    Attorney Carol E. Rosenthal Discusses Development in the City

    Land use attorney Carol E. Rosenthal is able to combine her appreciation of architecture, government, and law all in a day’s work as a partner at Fried, Frank, Harris, Shriver & Jacobson LLP. After contemplating a major in art, Rosenthal graduated from Brandeis University with a degree in political science. She then earned her law degree from New York University School of Law and began her legal career as a clerk for the United States Court of Appeals for the Ninth Circuit. Citing a desire to work on something “concrete,” Rosenthal entered private practice as a transactional real estate attorney.

    A major turning point in Rosenthal’s career occurred when she left private practice to become assistant counsel to the New York City Department of City Planning. She based the decision on her longtime interest in government and policy, and desire to have an impact on the City’s future. One of Rosenthal’s major projects while at Planning was helping to create the City’s Inclusionary Housing Program. She recalls the uncertainty at that time about the legal issues related to zoning incentives and how closely the benefits needed to be related to the impact of a proposed project in order to withstand judicial scrutiny. Rosenthal and her colleagues structured the program to require that the developer build the affordable housing geographically close to the development receiving the floor area bonus. This promoted the creation of heterogeneous mixed-income neighborhoods. (more…)

    Engineer barred for two years

    Court Decisions  •  Department of Buildings  •  Citywide

    Licensed engineer certified altered photos and submitted misleading application to Buildings. Buildings filed charges against engineer Leon St. Clair Nation after discovering he had certified the accuracy of altered photographs and submitted a false application to alter the second floor of a building which did not have a second floor. Buildings specifically charged St. Clair Nation with violating the City’s rules by knowingly or negligently submitting false or misleading documents.

    After a hearing at OATH, the Buildings Commissioner ordered the revocation of St. Clair Nation’s self-certification privileges. The Commissioner also prohibited St. Clair Nation from filing any application or document with Buildings for two years. St. Clair Nation filed an article 78 petition, claiming that the Commissioner lacked the authority to impose the two-year suspension because the construction code provision relied on by Buildings had been enacted after he had engaged in the acts charged against him.     Michael B. Gerrard Discusses His Career and the Future of Climate Change Regulation

    Michael B. Gerrard

    Michael B. Gerrard, director of Columbia Law School’s Center for Climate Change Law, traces his passion for environmental protection back to growing up in Charleston, West Virginia, a city dominated by major chemical manufacturing companies like Union Carbide and DuPont. As a child, he lived on the banks of the Kanawha River, where large amounts of toxic chemicals had polluted the water and air.

    After graduating from Columbia University, Gerrard worked for a local environmental policy group, which reaffirmed his interest in environmental protection. Believing that the most effective work in the field was being accomplished by lawyers, he entered New York University Law School in 1975 with the goal of becoming an environmental lawyer. (more…)
