    Court affirms dismissal of Atlantic Yards challenge

    ESDC’s determination upheld that three blocks outside urban renewal area were blighted. In 2003, Forest City Ratner proposed to redevelop a 22-acre site in Prospect Heights, Brooklyn. The site included portions of the Atlantic Terminal Urban Renewal Area and portions of three privately-owned blocks outside the renewal area. After Ratner’s proposal was accepted, the Empire State Development Corporation designated itself as lead agency for the project under state environmental law. ESDC prepared an environmental impact statement and a blight study, and later approved the findings in both documents, including the finding that portions of the three privately-owned blocks were blighted. A coalition of local business owners and residents challenged ESDC’s blight finding in the non-renewal area and the sufficiency of the environmental impact statement. Supreme Court Judge Joan A. Madden rejected the challenge, and the decision was appealed. 5 CityLand 16 (Feb. 15, 2008).

    On appeal, the coalition argued, among other things, that ESDC arbtrarily selected build years that distorted the project’s potential environmental impacts. The coalition also argued that ESDC’s failure to consider the positive real estate trends in the non-renewal area led it to unreasonably conclude that the proposed project was uniquely capable of alleviating blight in the non-renewal area. The coalition further claimed that ESDC’s finding of blight for the non-renewal area was unsubstantiated. (more…)

    City Reaches Settlement Agreement with Verizon FiOS Regarding Expansion

    The new agreement stresses the need for internet access. On November 24, 2020, Mayor Bill de Blasio announce efforts to tackle the digital divide in New York City by ensuring that Verizon builds out its FiOS footprint to 500,000 additional householders, making high-speed fiber broadband available to more New Yorkers. Verizon failed to meet the terms of its current cable franchise agreement made with the Bloomberg administration to build out its FiOS network. (more…)

    City Announces Play Streets Initiative and Open Streets Changes

    The Open Streets and the new Play Streets initiatives encourage New Yorkers to go outside. On July 24, 2020, Mayor Bill de Blasio announced Play Streets, an initiative provided by the City, the Fresh Air Fund, Building Healthy Communities, and the Police Athletic League to provide children with fun, socially-distant outdoor activities on twelve Open Streets throughout the City. The Open Streets initiative provides more outdoor space for pedestrians and cyclists by limiting vehicular traffic on specified streets. Mayor de Blasio also announced some streets that will be added and removed from the Open Streets program. (more…)

    UPDATED: City to Implement Up to 100 Miles of Safe Streets

    The plan will aim to add 100 miles of open streets, widened sidewalks and protected bike lanes. Note: This article has been updated to continuously reflect the added streets as those announcements are made. Please continue to check back for further updates.

    On April 27, 2020, the Mayor’s Office announced a plan along with Council Speaker Corey Johnson to implement street closures, sidewalk widening, and the addition of bike lanes as part of the City’s response to the COVID-19 outbreak. The plan aims to close off streets to cars to provide more space for social distancing for pedestrians and cyclists as the weather gets warmer and more people are expected to go outside.  (more…)

    Subway Trains, Injuries, Tort Claims and Defenses

    Early tort law was heavily weighted towards injuries that involved train accidents.  Here in the New York City metropolitan region with its huge dependence on rail transport, the older typical nineteenth century tort claims and defenses continue for injuries caused by subways, commuter lines and train equipment.
