Prior Notice Claim Advances

Pedestrian injured on a defect in the sidewalk owned by the City. Pedestrian Luis Sanchez was injured when he tripped and fell on a defect in the sidewalk located on Westchester Avenue between St. Ann’s Avenue and Brook Avenue in the Bronx. Sanchez sued the City. The City, citing the generality of the mark on a Big Apple Map, moved to dismiss the complaint for lack of prior notice.


Eviction Notice Ruled Deficient

Landlord of 2013 Amsterdam Avenue served a notice of termination on disabled tenant, after the tenant engaged in a series of housing code violations. After a series of incidents, including causing instances of flooding and refusing to allow the landlord access to effect repairs, 2013 Amsterdam Avenue Housing Association served the notice of termination on its tenant Darren King. King is a paraplegic, wheelchair-bound, double-amputee.


No Notice Required for Pothole Injury

Police officers were injured when their car struck a pothole that had been repaired by the City. On September 7, 2011, at about 12:40 a.m., while on patrol, two New York City police officers sustained personal injuries when their vehicle’s tire fell into a roadway hole located in the northbound lane of Saint Nicholas Avenue between 124th Street and 125th Street. 


City Defeats Bike Rider’s Claim

On June 2, 2016, Peter Deutch was riding his bicycle North-bound on East Drive in Central Park, Manhattan. East Drive is a three-lane roadway in Central Park with the left lane reserved for pedestrians, the middle lane designated for cyclists, and the right lane for motor traffic. U-Haul must pay truck renter’s fine

Renter of a vehicle owned by U-Haul allowed vehicle to idle for more than three minutes. A passerby noticed a U-Haul-owned vehicle idling at 455 West 48th Street in August 2020. The U-Haul’s engine appeared to be running for over four minutes without movement. The passerby videoed the vehicle with audible engine noise as a person sat in the driver’s seat.
